How will you safeguard your business against counterfeiting and piracy, especially when infringing goods are about to be imported into Malta or will be passing in transit (or as a transhipment) via Malta?

There exists specific IP legislation that regulates the above scenario. This legislation has as its object the withholding of the release of goods by the Comptroller of Customs where it is claimed that the same may infringe the intellectual property rights of another party. This law specifically prohibits the importation into Malta, and the exportation or re-exportation from Malta, the release for free circulation, temporary importation, placing in a free zone or free warehouse of goods in contravention of intellectual property rights.

In such cases, Mamo TCV is reputed to be amongst the very leading law-firms in Malta which has a proven track record of taking the largest number of legal proceedings (and ancillary measures) on behalf of right holders (we represent some of the world’s most famous brands across all sectors of industry – see below) in order to protect and safeguard their interests against the consequences of importation (even if temporary) of any such goods in or via the Maltese territory. Michael Psaila graduated Doctor of Laws from the University of Malta in 2004 after submitting a doctoral thesis entitled ‘The Raising and Maintenance of Capital’. He furthered his studies at Kings College London, where he obtained a Masters of Law degree in Corporate and Commercial Law.

Michael was called to the Bar in January, 2005 and was a partner at Simon Tortell & Associates since the firm was founded in May 2009 until it merged with Mamo TCV in July 2016.

Michael’s main areas of practice include banking and finance, capital markets, corporate and insolvency law.

He is a member of the Chamber of Advocates, the Institute of Financial Services Practitioners and the International Bar Association and is also recommended in most major legal directories. 

Dr. Edmond Zammit Laferla
Edmond Zammit Laferla is a partner with Mamo TCV Advocates and forms part of the Corporate department and Insurance department. His areas of specialisation include all aspects of corporate, civil and commercial litigation and regularly assists clients in a variety of related matters. Provides advice to local and foreign clients on various corporate matters including corporate governance. He has also been involved in privatisation procedures and in the negotiation and drafting of major contracts. Dr. Richard Camilleri
Richard Camilleri is a founder partner of the firm and has been described as a 'corporate all-rounder'. As counsel to various domestic and foreign clients, he has significant experience in a large variety of transactions including privatisations, share acquisitions, public offerings of debt and equity securities, real- estate and construction projects. Richard also advises clients on Competition Law, Intellectual Property Law and Employment Law. He also has significant experience in litigation and has represented clients in cases concerning a variety of maters including Competition Law, Unfair Competition Law, Intellectual Property Law and Employment Law Richard is also a senior lecturer in the Faculty of Law, at the University of Malta and has been lecturing since 1988.

Franco Vassallo graduated in law in 1983 and given a warrant to practice in 1984. before graduating he worked as a customs clearance clerk with the local unilever manufacturing representative exposing him on a first-hand experience to port and shipping practices from an end user perspective. Following graduation, he work in one of the oldest Maltese firm (Camilleri & Delia) until together with David Tonna and Richard Camilleri formed Tonna Camilleri and Vassallo which later (2000) merged with john Mamo & Associates to set up Mamo TCV. He is a keen reader, fisherman and walker.
Dr. Joseph Borg Bartolo
Joe Borg Bartolo is a partner in the corporate, insurance and general commercial practice group of the firm. As counsel to leading insurance companies and insurance brokers operating both in the Maltese and European markets he has gained invaluable experience in the insurance field generally. He is involved in several immovable property transactions on a continuous basis, mainly in the commercial property sector. With a wide array of commercial clients, he is mostly well known for blending legal knowledge and advice with practical commercial experience and expedience necessary to get the deal done. He is also very experienced in dispute resolution and has acted in a number of instances to resolve issues without the necessity of allowing the matter to be contested in judicial fora.
Dr. Antoine Camilleri
Antoine Camilleri is a partner in the intellectual property practice group of the firm. His experience includes taking care of patent, trademark and unfair competition law issues for the clients of the firm. Antoine has experience in trademark enforcement, opposition and cancellation proceedings, trademark clearance, investigation, prosecution and management of domestic and international trademark portfolios. He represents multinational companies to individual inventors in a wide variety of industries including information technology, alternative energy, consumer products, financial services, sports and fashion goods, pharmaceutical products (including generics), medical devices, electrical equipment, food and beverage, and tobacco products. Antoine has represented a substantial number of multinational companies in anti-counterfeiting matters in collaboration with the Maltese Customs authorities, in particular in Customs cross-border measures and related Court litigation. He is also the lead person within the firm in matters dealing with media law, information technology law and telecommunications law. Antoine has acted as (part-time) lecturer at the University of Malta in the Master of Laws (Magister Juris) in European & Comparative Law course (since 2003) and in the Doctor of Laws (LL.D.) course (since 2010), in both cases lecturing on intellectual property law. Antoine is also an examiner and supervisor of Doctor of Laws theses and Research Projects at the University of Malta.
Dr. Stephen Muscat
Stephen Muscat is a partner in the litigation department within the firm, assisting several clients, both corporate and individuals within the commercial and civil law sphere involved in court-related, arbitration and other tribunals work. Apart from dispute-resolution work Stephen also practices extensively within the general commercial and civil law sphere. In his practice, Stephen regularly deals and dealt with a myriad of issues for a diverse portfolio of clients, some of which are leaders in their field and high-net individuals, operating within the wholesale and retail, construction, services, hotel, oil and other industries.
Dr. Joseph Camilleri
Since 2003, Joseph Camilleri has worked in the Litigation and Alternative Dispute Resolution department of the firm on assignments encompassing several aspects of civil and commercial litigation, including bank finance, real estate and asset recovery in the shipping and aviation industries. Joseph also works in the administrative law sector, particularly in the fields of public procurement, private-public partnerships and planning law. In this regard, he regularly assists Government entities in legal issues relating to the drafting of tender documents and in the evaluation of tenders, as well as in the implementation of contracts following awards. He also regularly represents clients – hailing both from the public and private sectors – in proceedings before the Public Procurement Review Board and in appeals before the Superior Courts. In the field of planning law, Joseph has represented several clients in the private sector in planning appeals and has also worked closely with architects and architecture firms on projects requiring permits and authorisations.
Dr. Nicholas Valenzia
Nicholas Valenzia heads MamoTCV’s Shipping and Aviation Department with particular focus on assets management and finance issues. Nicholas has also vast experience in vessel (including superyachts) and aircraft ownership and operational structures. Nicholas also coordinates vessel and aircraft repossession procedures on behalf of international credit institutions. Main areas of focus: Ship, yacht and aircraft registration and finance; Ship, yachts and aircraft repossession; Asset finance; Asset management; Ownership and operational structures for ship, yacht and aircraft holding entities; Aircraft leasing and charters; Yacht leasing arrangements; Taxation of transport industry including related litigation; General Commercial Law; Litigation; All forms of land Transport.
Dr. Frank B. Testa
Frank Testa is a partner in the litigation and dispute resolution group of the firm. He was admitted to the bar in 2005 and after a couple of years of practise in the financial service industry in the City of London, he returned to Malta to concentrate on civil, commercial and administrative law. He has been advising various local and international companies as well as government entities since then. In doing so, he has gained significant experience in those fields as as well as real estate, public procurement and industrial law. Frank is regarded as one of the country’s main points of reference in hospitality law, where he has advised the government on the drafting of various pieces of legislation in the field.
Dr. katya Tua
Katya Tua heads the Investment Services department of the firm. She was called to the Bar in 2002 and joined the law firm GVTH Advocates as an associate in the same year. She joined Simon Tortell and Associates as a founding partner in 2009.She advises primarily international clients in the incorporation and licensing of all types of collective investment schemes including UCITS, alternative investment funds (“AIFs) and professional investor funds (“PIFs”). She also advises on the drafting and negotiation of associated documentation as well as on all ongoing legal support work that collective investment schemes require, particularly regulatory compliance Katya’s regulatory experience also includes the structuring and operations of asset management and administrators.
Andrew Muscat
Andrew Muscat is a Partner at Mamo TCV Advocates and heads the Corporate, Capital Markets, Insolvency and Banking practice groups. He has developed a wide-ranging commercial law practice advising corporate clients on corporate and commercial matters ranging from M&A transactions, corporate restructurings and corporate finance to privatizations and joint ventures. He regularly advises international banks in various forms of financing including project financing and merger and acquisition financing. As counsel to some of Malta’s leading publicly listed companies, he has gained considerable experience on capital markets issues, including bond issues, spin-offs, rights issues and voluntary and mandatory bids. He also regularly advises clients in dealing with distressed companies operating in the financial and commercial sectors. Andrew is also Professor of Commercial Law in the Faculty of Laws at the University of Malta where he has taught company law, insolvency law, banking law and credit instruments.
